2. Scope of this Policy

This Policy applies to orders concluded with nvolts s. r. o. through distance communication methods, including quotation-based orders, email orders, and other remote ordering channels used by nVolts.

Because nVolts supplies both:

  • standard stock products;
  • custom-made products;
  • custom PCB design;
  • engineering, consulting, prototyping, and related technical services,

different return, refund, and withdrawal rules may apply depending on:

  • whether the customer is a consumer or a business customer; and
  • whether the order concerns standard goods, custom-made goods, or services.

This Policy must be read together with our Terms of Sale & Services.

3. Definitions

For the purposes of this Policy:

Consumer means a natural person acting outside their trade, business, or profession.

Business customer means a person or entity acting within a trade, business, profession, or commercial activity.

Standard product means a non-customized product offered by nVolts as a regular stock item.

Custom-made product means any product manufactured, configured, designed, assembled, programmed, or modified according to the customer’s specific requirements.

Services include, without limitation, PCB design, engineering work, consulting, prototyping, testing, development, integration, technical support, and project-specific work.

4. Consumer Right of Withdrawal for Standard Products

If you are a consumer and you purchase a standard, non-customized product by distance means, you may have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which you, or a third party indicated by you other than the carrier, acquires physical possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision by a clear written statement before the withdrawal period expires.

You may use the model withdrawal form at the end of this Policy, but it is not mandatory.

5. Effects of Withdrawal

If you validly withdraw from a contract, we will reimburse all payments received from you for the relevant goods, including the cost of standard delivery where required by law.

We will make the reimbursement without undue delay and no later than 14 days from the day on which we receive your withdrawal notice.

However, we may withhold reimbursement until:

  • we have received the returned goods; or
  • you have supplied evidence of having sent back the goods,

whichever occurs first.

Refunds will be made using the same means of payment used for the original transaction, unless you expressly agree otherwise.

6. Return of Goods After Withdrawal

If you exercise your right of withdrawal, you must send back the goods without undue delay and no later than 14 days from the day on which you informed us of your withdrawal.

The deadline is met if you send back the goods before the 14-day period has expired.

Unless otherwise agreed, the direct cost of returning the goods is borne by the customer when the return is due to a change of mind.

Returned goods must be packaged properly and safely to prevent transport damage.

7. Condition of Returned Goods

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

This means you may inspect the goods as you would in a physical store, but you should not use them beyond what is reasonably necessary for inspection.

If returned goods show excessive handling, use, damage, missing parts, or other reduction in value not caused by transport, we may reduce the amount refunded accordingly, to the extent permitted by law.

8. Exclusions from the Right of Withdrawal

The consumer right of withdrawal does not apply, to the extent permitted by applicable law, to:

  • goods made to the consumer’s specifications;
  • clearly personalized products;
  • custom-made or configured electronics;
  • custom PCB design or project-specific boards;
  • bespoke assemblies, programmed devices, prototypes, and made-to-order systems;
  • services that have been fully performed where performance began with the consumer’s prior express consent and acknowledgment that the right of withdrawal would be lost once the service was fully performed;
  • digital or software-related deliverables where the applicable conditions for exclusion are met;
  • any other category lawfully excluded from the withdrawal right under applicable law.

For the avoidance of doubt, custom engineering work, custom PCB design, configured products, prototypes, and other project-specific work are generally non-cancellable and non-returnable once accepted and/or started, except where mandatory law provides otherwise.

9. Services Begun During the Withdrawal Period

If a consumer requests that we begin performing services during the withdrawal period, and the consumer later withdraws from the contract, the consumer shall pay us an amount proportionate to the services already provided up to the time of withdrawal, where applicable law permits this.

If the service has already been fully performed under conditions that legally exclude the withdrawal right, no withdrawal right will apply.

10. Faulty, Damaged, Incorrect, or Non-Conforming Goods

This Policy does not limit or exclude any mandatory rights relating to defective or non-conforming goods.

If you receive goods that are:

  • defective;
  • damaged in transit;
  • incomplete;
  • incorrect; or
  • not in conformity with the contract,

please contact us without undue delay at support@nvolts.eu and provide, where possible:

  • your name and contact details;
  • order or quotation reference;
  • description of the issue;
  • photographs or video evidence where relevant;
  • serial number or identifying product details, if available.

After review, and where the claim is justified, we will provide an appropriate remedy in accordance with applicable law and the circumstances of the case. The remedy may include:

  • repair;
  • replacement;
  • price reduction; or
  • refund.

If the issue is due to our error, confirmed defect, or damage existing before delivery to you, we will bear reasonable return costs or provide return instructions.

11. Transit Damage

If the outer packaging or goods appear damaged at the time of delivery, we recommend that you:

  • inspect the package immediately;
  • note visible damage with the carrier where possible;
  • take photographs;
  • notify us as soon as possible.

This helps us handle the matter more efficiently, but it does not reduce any mandatory legal rights you may have.

12. Business Customer Returns

Business customers do not have a consumer right of withdrawal.

For business customers, returns are accepted only in defect-based cases or where expressly agreed in writing in advance by nVolts.

No-change-of-mind returns are accepted from business customers unless we expressly approve them in writing.

Custom-made products, project-specific assemblies, configured electronics, custom PCB designs, and bespoke technical services are non-returnable for business customers except in the case of a valid defect claim or where mandatory law requires otherwise.

13. Custom Products and Custom Technical Work

The following are treated as custom, bespoke, or project-specific items and are generally non-returnable and non-refundable once accepted, started, or produced:

  • custom PCB design;
  • engineering design work;
  • configured boards and control systems;
  • prototypes;
  • firmware-related deliverables;
  • custom enclosures or tailored electronic assemblies;
  • integration work;
  • testing, consulting, and technical studies;
  • other products or services prepared specifically for the customer.

If a customer cancels custom work after acceptance or after work has begun, nVolts may charge for:

  • work already performed;
  • engineering time already spent;
  • procured components or materials;
  • non-cancellable supplier costs;
  • testing or third-party expenses already incurred.

14. Refunds in Defect Cases

If a refund is approved due to a valid complaint, defect, cancellation accepted by us, or other lawful reason, the refund will be processed using the same payment method originally used, unless otherwise agreed.

Refund timing may depend on:

  • inspection of returned items;
  • confirmation of defect or non-conformity;
  • receipt of the returned goods;
  • verification of payment details.

15. Non-Refundable Items and Costs

Unless otherwise required by law or agreed by us in writing, the following are generally non-refundable:

  • custom-made products;
  • engineering and design work already performed;
  • custom PCB design work already started;
  • prototype development work already started;
  • programmed, configured, or modified goods;
  • urgent project work initiated at the customer’s request;
  • third-party procurement costs already incurred for the customer’s project;
  • shipping costs for returns made solely due to customer preference.

16. Warranty

Mandatory statutory rights remain unaffected.

In addition to any statutory rights, nVolts may provide a commercial warranty of 12 to 26 months, depending on the specific product. The exact warranty period, if applicable, will be stated on the product page, quotation, invoice, or accompanying documentation.

The commercial warranty, where offered, does not cover defects or damage caused by:

  • misuse;
  • improper installation;
  • incorrect wiring or operation;
  • unauthorized modification or repair;
  • operation outside specified technical limits;
  • external electrical faults or unsuitable operating environment;
  • customer-supplied faulty data, drawings, files, or specifications;
  • normal wear and tear.
